Wisconsin Paternity

Unless and until a person is established legally as the biological father of a child, he has few rights. He cannot enforce a parenting schedule, make legal decisions related to the child's upbringing. A paternity proceeding may be brought at any time after the birth of a child.

Under Wisconsin law, there are several ways that paternity may be legally established:

Texas Paternity

A paternity action can be brought by the mother or expectant mother, by a man alleging to be the biological father, by the child, or the Welfare Department. In most circumstances, the action must be filed within two years after the child is born. In certain situations, the child may bring the action before reaching the age of twenty years old.

In Pennsylvania, when a child is born to unmarried parents, there is no legal relationship between the father and the child. Unmarried parents can establish a legal relationship between the father and the child. This is called paternity establishment.

When a child is born out of wedlock, a legal proceeding must be conducted to legally determine the biological parents of the child. An order of paternity must be entered before such things as child support, visitation, and custody can be ordered.

New York Paternity

Paternity is the term by which a father is granted legally enforceable rights and responsibilities to his child. Paternity may be established in one of three ways:

  1. If the parties are married, New York presumes the husband of any children of the marriage. This presumption can be rebutted.

 

  1. Paternity can be established by the proper execution of an acknowledgment of paternity. See Family Court Act Section 516.

New Jersey Paternity

Before the state can start to establish paternity, an allegation of paternity must be made by the child's mother, the custodial parent (if it isn't the mother), a man claiming to be the child's biological father, or the child.

After the allegation is made, the process to establish paternity will begin within 90 days of locating the alleged father.

Nebraska Paternity

According to the law, both parents are responsible for a child's upbringing, both emotionally and financially. In situations where the parents of a child have never been married to each other, a paternity case can be brought by either the father or mother. The paternity case:

  • Establishes that the father is the legal, biological father of the child.

 

  • Determines custody and visitation;

 

  • Sets Child Support according to the Nebraska Child Support Guidelines;

Michigan Paternity

Paternity is a gender biased word that means being a father. In Michigan, Paternity can be established in several ways. Most often, Paternity actions are brought under the Paternity Act, MCLA 722.711, or Child Custody Act and sometimes the Acknowledgment of Parentage Act, MCLA 722.1001. By signing an affidavit of parentage, which gives a child born out of wedlock, or born or conceived during marriage but not an issue of marriage the same status as a legitimate child. Paternity Acknowledgment is the voluntary process of unwed father's being recognized as the alleged biological father.

Maryland Paternity

Establishing legal fatherhood: Under Maryland law, a child born to parents who are not married has no legal father. There is a difference between a biological father and a legal father. Give your child a legal father by establishing legal fatherhood or paternity.
